Who to speak to CPO checklist wrong?

Recently bought a certified pre owned 3 hatchback AWD and about a month into ownership noticed that two of the tires are of a different brand. The CPO checklist says all tires must be the same brand, size etc. Do I have a case to ask for a full set of new, matching tires? I wouldn’t want just two new tires because of the difference in tread depth unless they were able to shave them down.

Thoughts?
